Terms of Service
Last updated: September 16, 2026
These Terms of Service (the “Terms”) govern your access to and use of MaxDomains, a domain discovery and price comparison service operated by MaxPoints LLC, doing business as MaxPoints (“MaxPoints,” “we,” “us,” or “our”). MaxDomains includes our website, domain search, price comparisons, registration ordering, account features, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Eligibility and authority
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services. If you use MaxDomains for a company, client, or other organization, you represent that you are authorized to accept these Terms and act on its behalf.
What MaxDomains provides
MaxDomains helps you explore possible domain names and compare live first-year and renewal prices across a curated set of extensions. Search results are supplied through OpenSRS, but a search does not reserve a domain or guarantee that it will remain available at the displayed price.
Active MaxNova members may submit eligible registrations through MaxDomains for processing by OpenSRS. MaxDomains is not itself an ICANN-accredited registrar or registry. OpenSRS and the applicable registry retain authority over availability, registration, eligibility, suspension, transfer, renewal, and cancellation.
After registration, eligible members may ask MaxDomains to point the domain's website records to MaxVolts and continue into a selected MaxChef project. You authorize those DNS changes when you use that action. MaxDomains can act only on a project you explicitly authorize through MaxChef, and Chef rechecks that authorization before it stages the domain for verification and HTTPS activation.
Prices and third-party services
Displayed currency is identified with each result. Prices include a 15% markup on the current OpenSRS reseller cost for members, or a 30% markup for non-members. Stripe collects the full displayed price before registration is submitted. Prices, renewal rates, fees, and taxes can change at any time, so MaxDomains checks the price and availability again immediately before submitting an order.
By placing an order, you authorize MaxDomains to submit the domain, account email, and registration contact details to OpenSRS and acknowledge that payment must succeed before we submit the registration. If availability or price changes before submission, we arrange a refund. An uncertain registrar response is reviewed before any retry. Successfully processed registrations may be final and non-refundable, subject to the purchase terms and applicable law. OpenSRS is governed by its own terms and registry policies. You are responsible for providing accurate contact data and reviewing applicable provider terms before ordering.
Auto-renew is off for new orders. You can renew an active, unexpired domain for one year at a time from your dashboard; it is renewed only after payment is confirmed, and a renewal that cannot be applied is refunded. You can turn off an existing renewal preference. Turning it off does not cancel a renewal already processed by the registrar.
Renewals, expiration, and transfers
A domain registration gives time-limited registration rights under the registrar and registry rules. Keep registrant contact details and payment information current and respond to verification and renewal notices. Auto-renew is not a guarantee of renewal: payment failure, account restrictions, or registry requirements may prevent it. Confirm that a renewal actually completed before the domain expires.
Review the registration term, renewal price, post-expiration renewal charges, and any restoration fees disclosed before purchase or renewal. Expiration can interrupt your website and email and can lead to loss of the domain. Grace periods, restoration availability, transfer locks, and deadlines vary by extension and registrar policy. Do not assume an expired domain can be recovered.
Registration and use are subject to the applicable registrar agreement, registry eligibility rules, and domain dispute policies, including ICANN policies where applicable. A MaxNova membership cancellation does not itself cancel a registration or its auto-renew preference. Contact us for assistance with renewal, transfer, or registrant changes; a pending request is not confirmation of completion.
DNS changes and connected projects
By requesting a domain connection, you authorize the displayed DNS and, where required, nameserver changes. Review existing website, email, and verification records first; nameserver changes can affect services that depend on those records. DNS propagation, ownership checks, and HTTPS issuance may delay activation. Connecting a domain does not purchase hosting or guarantee email sending readiness.
MaxAuth provides shared sign-in and membership verification. Member pricing requires current eligibility. Payment, registrar processing, and any required approval must complete before a registration is confirmed. We will not treat a search result or pending order as a completed registration. Any required price-change consent must be obtained before charging a different amount; mandatory refund rights remain unaffected.
Accounts and security
Some features use your MaxAuth account. You agree to provide accurate account information, keep your sign-in credentials secure, and promptly notify MaxPoints if you suspect unauthorized access. You are responsible for activity performed through your account to the extent permitted by law. You may not impersonate another person, misrepresent your affiliation, or access another account without authorization.
Searches, orders, and domain rights
Search terms and displayed results do not give you any ownership, priority, or other rights in a domain name. Rights arise only if the registrar and registry successfully complete a valid registration order.
Before registering or using a domain, you are responsible for determining whether the name violates a trademark, publicity, privacy, contractual, or other third-party right. MaxDomains does not provide trademark clearance, legal advice, or a determination that a domain is lawful or suitable for your intended use.
Your content and feedback
You retain ownership of information you submit through the Services. You represent that you have the rights necessary to submit it and that doing so will not violate any law, contract, or third-party right. You grant MaxPoints a non-exclusive, royalty-free license to process that information only as reasonably necessary to provide, secure, maintain, support, and improve the Services, comply with law, and enforce these Terms.
If you voluntarily provide ideas or feedback about MaxDomains, you allow MaxPoints to use them without restriction or compensation to you. This does not give MaxPoints ownership of your separate pre-existing materials.
MaxPoints intellectual property
The Services and the software, designs, text, graphics, logos, and other materials provided by MaxPoints are owned by MaxPoints or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purposes.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, create derivative works from, or otherwise exploit the Services or MaxPoints materials except as expressly permitted by us in writing, by an applicable open-source license, or by law.
Acceptable use
You agree not to use the Services to:
- violate any applicable law, contract, or third-party right;
- submit unlawful, infringing, deceptive, abusive, or harmful content;
- access another account, system, or data without authorization;
- develop, distribute, transmit, or facilitate malware or other harmful code;
- interfere with or circumvent the security, integrity, access controls, or operation of the Services;
- send spam or make abusive, deceptive, or unauthorized requests;
- scrape, harvest, or collect data except as expressly permitted by us or applicable law; or
- use the Services in a way that could harm MaxPoints, our users, third parties, or their systems.
Service changes and termination
We may modify, suspend, restrict, or discontinue all or part of the Services, including registrar integrations and account features. We may suspend or terminate access if you violate these Terms, create risk or possible legal exposure, or use the Services in a way that could harm MaxPoints, our users, or others. Where reasonably practicable, we will provide notice of a material suspension or discontinuation. Provisions that by their nature should survive termination will remain in effect.
Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL DOMAIN AVAILABILITY, PRICING, AND RENEWAL INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE.” MAXPOINTS DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES OR THEIR INFORMATION WILL BE UNINTERRUPTED, SECURE, CURRENT, ACCURATE, COMPLETE, ERROR-FREE, OR SUITABLE FOR YOUR NEEDS.
Some jurisdictions do not allow certain warranty disclaimers, so some exclusions may not apply to you. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MAXPOINTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, SUCCESSORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, USE, DOMAIN OPPORTUNITY, OR DATA, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
These limitations do not apply to liability that cannot be limited or excluded under applicable law. Your use of the Services is at your own risk, and you are responsible for confirming domain information and for decisions or transactions you make based on the Services.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless MaxPoints and its officers, directors, employees, contractors, affiliates, successors, and agents from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from your misuse of the Services, your violation of these Terms or applicable law, your infringement of another person’s rights, or your registration or use of a domain. MaxPoints may assume control of the defense of a matter subject to indemnification, and you agree to cooperate with that defense.
Governing law and dispute resolution
These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, and by applicable federal law, including the Federal Arbitration Act where applicable.
Before starting formal proceedings, you and MaxPoints agree to attempt in good faith to resolve the dispute informally for at least 30 days after one party gives the other written notice. Notices to MaxPoints must be sent to 18121 E Hampden Ave Unit C #1244, Aurora, CO 80013.
If the dispute is not resolved informally, it will be resolved by binding arbitration on an individual basis, except that either party may bring an eligible claim in small claims court or seek injunctive relief for actual or threatened infringement or misuse of intellectual property. The arbitration will take place in Colorado, or remotely if the arbitrator permits, under the Colorado Uniform Arbitration Act and applicable federal law. Each party will be responsible for arbitration fees only to the extent permitted by applicable law and the rules selected by the arbitrator.
Waiver of class actions
To the fullest extent permitted by law, you and MaxPoints agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. If this waiver is found unenforceable for a particular claim, that claim must be resolved by a court of competent jurisdiction and not in arbitration.
Changes to these Terms
We may update these Terms as the Services or legal requirements change. We will post the updated Terms and revise the “Last updated” date above. Changes take effect when posted unless a later date is stated. Your continued use of the Services after updated Terms take effect constitutes acceptance of the changes.
General terms
These Terms and the Privacy Policy constitute the entire agreement between you and MaxPoints regarding the Services and supersede prior or contemporaneous communications on that subject. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; MaxPoints may assign them in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.
